Charlie Lowe, 11, filmed a video about drunk drivers moments before his death

11-year-old Charlie Lowe filmed a video of himself talking about the risks of drunk drivers just minutes before his death.

On their way home from The Pembroke on the 5 August 2023, Charlie made a video of himself and his dad, Dean, on his phone, as they walked back from celebrating a birthday with friends and family.

In the footage, captured shortly after leaving the pub at 9:20 pm, Charlie speaks about how his father was holding his hand as they crossed roads and speaks to his dad about, hypothetically, being 'hit by a drunk driver'.

Minutes later, 48-year-old Dean and young Charlie Lowe were killed on La Rue de Fauvic at 9:40 pm.

On the first day of what is expected to be an eight-day trial, the Royal Court was shown the phone footage as part of the prosecution’s opening statement, which pieced together a timeline of events from the tragic night.

The accused, Dylan John Pounds denies causing the deaths of Dean and Charlie Lowe by dangerous driving, causing death by careless driving while under the influence of drink or drugs, and using a mobile phone whilst driving.

The 29-year-old has admitted the lesser charges of causing their deaths by careless driving and of failing to stop and report an accident.

The prosecution says Dylan Pounds started an afternoon 'drinking session' at 'multiple establishments' by driving to the Union Inn at around 1:48 pm, in his work van.

Jersey's Royal Court then watched CCTV footage of Pounds and a friend arriving at The Pembroke at 3:46 pm, going to the bar and ordering two pints of lager.

The pub's security cameras captured the accused drinking a total of six pints throughout the afternoon.

The prosecution says Dylan Pounds then caught a lift to the Dolphin in Gorey, at around 8:25 pm, with a group of people he met that evening - leaving his work van in The Pembroke's car park.

More CCTV footage appears to shows the group ordering drinks at the bar. After 50 minutes, Dylan Pounds and his friend can be seen running for the bus.

The prosecution told the court that, at 9:20 pm, security cameras on the bus show the pair pleading with the driver to let them on, with Pounds' friend paying for the pair's tickets back to Liberation Station, St Helier.

However, minutes after getting on, the 29-year-old speaks to his friend, who the court sees shaking his head as Dylan Pounds gets off at Grouville Station.

The court heard that The Pembroke's car park CCTV then picks up Dylan Pounds walking towards his van and driving to leave the pub, before stopping momentarily at the exit at 9:37 pm.

The prosecution say that phone records show Dylan Pounds rang the same friend,  at the time it is alleged he was driving back into town.

During the time of that phone call, the van was seen on multiple CCTV cameras driving at speeds estimated between 41 mph and 50 mph.

The court was told that La Rue de Fauvic has a speed limit of 30 mph, no pavement and many bends.

The prosecution says other drivers came forward saying they saw Dean and Charlie walking, with one motorists seeing the pair moments before also passing a van driving towards town.

The court heard that at 9:40 pm the phone call between Dylan Pounds and his friend ends.

The prosecution told the Royal Court that Charlie and Dean Lowe were 'hit from behind with enormous force', at 9:40 pm on 5 August 2023, with the 48-year-old father's body found almost 40 metres away from the point of impact.

Despite the efforts of first responders and emergency services, the pair suffered 'unsurvivable' injuries after being 'left dead or dying' on the road, the court heard.

Dean Lowe was pronounced dead at 11:15 pm, with his 11-year-old son pronounced dead at 12:01 am.

Dylan Pounds was seen on CCTV driving to St Helier, through Five Oaks and past Overdale.

The accused then drove down Cheapside and Kensington Place before arriving at the Inn on the Park car park.

Another phone call was made to the same friend at 10:04 pm which lasted just under three minutes.

The prosecution says the work van was found in the car park the same night by a member of the public.

Photos shown to Jersey's Royal Court reveal a badly damaged Volkswagen van with a smashed windscreen and a dent in the bonnet.

Dylan John Pounds was identified as the usual driver of the company van and arrested the following day.

When police searched the accused's mobile phone they found deleted call logs to the friend's number.

The trial continues and is expected to last eight days.
